WG-Tenure | Munculnya tekanan publik terhadap hutan, sebagian dikarenakan belum adanya batas yang jelas, kurangnya keterbukaan informasi, adanya persaingan kebutuhan lahan, lokasi lahan hutan yang berdekatan dengan lahan pemukiman, peraturan perundang-undangan yang tidak diterapkan secara ketat, dan persepsi para pihak yang berbeda memandang hutan tersebut. Hal ini merupakan permasalahan tenurial yang dapat berkembang menjadi konflik. Penyelesaian masalah ini pun harus terintegrasi dan membutuhkan dukungan dari semua unsur terkait.WG-Tenure | The emergence of public pressure on the forests, partly because there has been no clear boundary on information and forest areas, competing needs of land, forest land proximity to residential areas, laws and regulations which are not applied strictly, and different perceptions of the forest by multi stakeholder. Tenure problems evolved into tenure conflict and social conflict which cause by overlapping of land and resources use by local community, government or companies. Resolving of these issues must be integrated and needs the support from all relevant elements.

Working Group on Forest Land Tenure (WG-Tenure) mendukung fasilitasi dan mediasi penyelesaian konflik tenurial di KPH Berau Barat yang dilakukan oleh Pusdal Regional 3. Proses mediasi dan fasilitasi ini digelar di Twin Plaza Hotel-Jakarta pada 13-14 November 2014.

Fasilitasi ini telah menghasilkan penandatanganan MoU atas penyelesaian masalah tenurial lahan di PT. Inhutani I Labanan Satuan. Dalam MoU tersebut telah mempertimbangkan beberapa aspek:

1. Hasil Land Tenure Assessment di 5 kampung yang berada di area konsesi PT. Inhutani I Labanan yang dilaksanakan pada 27 Oktober – 1 November 2013.
2. Workshop Multi-Stakeholder di tingkat Kabupaten Berau yang dilaksanakan pada 19-20 November 2013 di Singkuang Café, Kabupaten Berau, Provinsi Kalimantan Timur.
3. Publikasi  dan ekspose di tingkat Nasional pada 22 Januari 2014 di Hotel Fave Padjajaran, Bogor.
4. Proses Mediasi dan Fasilitasi Penyelesaian Konflik Tenurial antara perusahaan dan masyarakat  Kampung Tumbit Dayak oleh Pusdal Regional 3 (Kalimantan) yang berlangsung pada 9-12 September 2014 di Tanjung Redeb, Kabupaten Berau.

Isi dari MoU ini menekankan bahwa masing-masing pihak secara bersama-sama sepakat untuk menghentikan kegiatan pembukaan lahan di kawasan hutan. Selain itu, juga bersepakat untuk melakukan inventarisasi, pendataan, dan pemetaan serta demarkasi batas-batas lokasi kegiatan yang tumpang tindih di kawasan hutan antara PT Inhutani, KPH, dan masyarakat. Mereka juga sepakat untuk memfasilitasi pengelolaan kemitraan pada area-area yang saling tumpang-tindih antara 5 kampung dengan PT. Inhutani. Terakhir, mereka setuju untuk mempercepat penyelesaian batas administrasi antar desa/kampong.

Kairupan, S.Sos (TNC), Dwi Suciana (Fasilitator), dan perwakilan dari kampong-kampung di sekitar KPH Berau Barat (Kampung Tumbit Dayak, Kampung Labanan Makarti, Kampung Batu Rajang, Kampung Gunung Sari).

In accordance to the Regulation of the Minister of Forestry (Permenhut) No.P.33/Menhut-II/2012 art.842, PUSDAL Regional 3 obliged to conduct facilitation and mediation on tenure issues settlement in forest area. The facilitation was conducted by PUSDAL Reg.3 supported by WG-Tenure held on 13-14 November 2014 at Rose Room in Twin Plaza Hotel, Jakarta. It was attended by Bpk. Basuki (Minister Expert Staff (SAM) of Forest Security); Dr. Ir. I Nyoman Yuliarsana, M.Agr.Sc (Head of PUSDAL Regional 3); Asep Y. Firdaus, SH, MH and Ir. Emila Widawati (WG-Tenure); Hamzah, S.Hut, M.Si (Head of FMU Berau Barat); Yusuf Gunawan, S.Hut (Forest Agency of Berau District); Bastian, ST, M.Si (representative of Planning and Regional Development Board of Berau Distric); Ahmad Yani, S.Sos, Ding Ba (representatives of Kampong Tumbit Dayak); Mudawi (Head of Kampong Labanan Makarti); Sirajudin (Secretary of Kampong Batu Rajang); Yunus (Head of Kampong Gunung Sari); Ir. Oga Dhany Prayoga and H. Najemuddin, SE, Ak.CA (representatives of PT. Inhutani I); Dedi Kusnadi (representatives of PT. Berau Coal); Budi Susanto, S.Si (representatives of GIZ Forclime); Achmad F. Kairupan, S.Sos (representative of TNC); and Ms. Dwi Suciana acts as facilitator.

This facilitation has resulted on signing a MoU on resolving of land tenure problems in PT. Inhutani I Unit Labanan. The preparing of MoU has considered several points such as (1) Result of Land Tenure Assessment in the community of 5 (five) Kampongs which located in concession area of PT. Inhutani I Labanan that conducted on Oct 27 – Nov 1, 2013; (2) Multi stakeholder workshop on District Level at Singkuang Café, Berau Distric, East Kalimantan on 19-20 November 2013; (3) An expose and publication at National Level on Jan 22, 2014 at Fave Hotel Pajajaran, Bogor; and (4) Facilitation on mediation between company with people of Kampong Tumbit Dayak, supported by PUSDAL Regional 3 (Kalimantan). Held on 9-12 September 2014 at Tanjung Redeb, Berau.
This MoU emphasized on several points such as the parties jointly agreed to suspend land clearing activities in forest areas, and agree to conduct an inventory, data collection and mapping also demarcation of boundaries on the location of the overlapping activities in forest areas between region of PT. INHUTANI with FMU areas and local community. Besides, they agree to facilitate the management partnerships on the overlap areas between community in 5 (five) Kampong with PT. INHUTANI, and lastly agree to accelerate the completion of the administrative boundary between villages/kampong.
WG-Tenure with financial support by GIZ will support and accommodate the process of (1) inventory, documentation and land tenure mapping; (2) facilitate partnership scheme design between PT. Inhutani I with communities which located near the company; (3) acts as coordinator for participatory mapping on Administrative Border at Kampong Tumbit Dayak, Batu Rajang, Labanan Makarti and Gunung Sari.
